An Elizabethtown man arrested a week ago and accused of having sexual relations with an underage girl has been indicted by a Hardin County grand jury.
Francisco J. Vasquez, 45, faces charges that include second-degree rape, second-degree sodomy and second-degree sexual abuse.
Forcible contact is not alleged. However, the girl is younger than 16, which is the age of consent by Kentucky law.
According to the indictment, the incidents occurred June 16.
An indictment is an allegation, not proof of guilt. Vasquez is innocent until proven guilty.
According to Elizabethtown Police Department, the female contacted law enforcement about a possible domestic situation and sexual offense.
Vasquez was not at home when investigators arrived, according to a citation. When he returned later, he allegedly provided a note to a relative indicating he made a “big mistake.”
Vasquez remains lodged at the Hardin County Detention Center in lieu of a $10,000 cash bond. Arraignment has not been scheduled.
Second-degree rape is a Class C felony, punishable by five to 10 years in prison if found guilty, according to Kentucky Revised Statutes.
