District Judge John Simcoe decided Monday to put the case of a Fort Knox man charged with incest before a grand jury.
Aubra Green, 24, is charged with having relations with a female relative between the age of 13 and 16 on Sept. 6, 2010. He was arrested June 8.
Green, a specialist in the U.S. Army, was stationed at Fort Knox and living in Radcliff at the time of the incident.
Detective Thomas Bingham of the Radcliff Police Department was the commonwealth’s witness at Monday’s probable cause hearing. Bingham said RPD responded Sept. 6 to a “domestic disturbance” at Green’s Radcliff residence.
The girl accused Green of having sexual relations with her and was transported to University Hospital in Louisville for a sexual assault kit, Bingham said.
Though Green denied having sexual relations with the juvenile when police interviewed him, DNA he provided matched a sample found on the girl, Bingham said.
RPD spokesman Bryce Shumate said earlier this month the charges filed against Green are based entirely on DNA sampling.
Bingham could not recall Monday if the sexual assault kit showed signs of forcible rape, he said. No bruises or injuries were found on the accuser.
A female family member is the only witness, Bingham said. After the alleged incest occurred, the witness discovered Green and the girl in the living room of the Radcliff residence, she told police. The victim was found with her underwear around her ankles, and there were signs that sexual activity had occurred the witness said.
During the accuser’s interview with police, she said the sexual relationship between herself and Green had been going on for more than a year, Bingham said.
Green has not had any contact with the victim since the allegations were made last September, Bingham said.
Defense made a motion to reduce Green’s bond, set at $50,000 cash. Simcoe denied the motion because of the seriousness of the crime.
Green is lodged in the Hardin County Detention Center. The grand jury will review his case within the next 60 days.
