A Radcliff man, charged as a juvenile on four counts of sexual assault in November, has been indicted on the charges by a Hardin County grand jury one month after he turned 18.
Mario Tzunux-Zacarias turned 18 on March 1.
He and his brother, Isabel Tzunux-Zacarias, 20, were arrested Dec. 3 and charged after police say they broke into a Westport Road residence on Nov. 25 and raped a woman.
According to a news release from the Elizabethtown Police Department and an arrest citation, the pair broke into a residence in the 600 block of Westport Road and found an adult woman upstairs. Police believe the woman was acquainted with the suspects.
The defendants grabbed the victim and duct-taped her hands, mouth and eyes. They then took turns holding the victim down against her will on her bed as the other defendant raped and sodomized the woman for approximately 30 minutes.
They then duct-taped the victims legs prior to fleeing the scene.
Both men are charged with complicity to first-degree rape; complicity to kidnapping of an adult; complicity to first-degree burglary and complicity to first-degree sodomy – all Class B felonies punishable by 10 to 20 years in prison, if convicted.
Isabel Tzunux-Zacarias was indicted on the charges in January and is being held in lieu of a $100,000 cash bond in the Hardin County Detention Center.
As of Wednesday, it is unknown what detention facility Mario Tzunux-Zacarias is at. He had been sent to a juvenile detention center in Bowling Green after his arrest.
